The Regulation on the application of Article 81(3) of the Treaty to categories of technology transfer agreements, No. 772/2004, was enacted by the Commission of the European Communities. This Regulation replaced the Regulation (EC) No. 240/96. The Regulation came into force on 1st May, 2004 and it shall apply until 30th April 2014. The Regulation is directly binding and shall apply to all Member States. Hence, the provisions of this Regulation can be also invoked by all individuals of the Member States.
